The clash between Brussels and the Viktor Orban government for LGTBI rights is going in crescendo. A day after the European justice censored the Hungarian Law on the access of minors to LGTBI content, the Magaria Executive has announced that it will prohibit the flag of this group from flushing in public buildings.
According to the government, this veto aims to “guarantee the protection and care necessary for the adequate physical, mental and moral development of children” and stop “propaganda” aimed at minors. This decree prohibits the use of symbols that “refer or promote different gender sexual orientations, as well as the political movements that represent them.”
A measure, which on the other hand has a more symbolic power than real since in Hungary the rainbow flag does not usually wave in public buildings. The city of Budapest is one of the few exceptions and its mayor, Gergely Karacsary, has already announced that it will challenge this new regulations and that the collective flag will continuebeing present at the City Council of the capital.
This last Thursday, the general lawyer of the EU Court of JusticeIt was pronounced against a law promulgated in the year 2021 that restrictsor prohibits the access of minors toContents that promote present or promote “gender identities that do not correspond to sex assigned to birth, sex change or homosexuality.”
Although the general lawyer’s opinion is not binding, in a large majority of cases it usually anticipates the final ruling of the high court. According to the lawyer, Tamara Capeta, this new law is contrary to community legislation on digital services and the Charter of Fundamental Rights of the European Union. As for the latter, the opinion ensures that Hungarian regulations violate “the prohibition of discrimination due to sex and sexual orientation, respect for private and family life,Freedom of expression and informationand the right to human dignity. “In addition, according to Capeta,” Hungary has not provided evidence of the potential risk of damage to the healthy development of minors caused for the content describing the ordinary lives of LGBTI people. Therefore, these modifications They are based on a value judgment according to which homosexual life and non -cycling life do not have the same value or status as heterosexual and cisgenero life. ”
The Orban government has reacted furiously before this opinion. “PHe arves that the dissemination of sexual propaganda is more important for Brussels than protecting the rights of children. It’s crazy! “Orbán said yesterday in his account of social network X.
This may not be the only sentence against Hungary. Brussels is studying acting against the country after the government has introduced changes in legislation to shield the prohibition of lgtbi pride marches.
This reform ensures that “The right of the minor to the proper physical, mental and spiritual development will prevail over all other fundamental rights, with the exception of the right to life ”, which assumes that the right of meeting is subordinated to this“ childhood protection. ”This regulation even allows the authorities to use facial recognition tools to identify the attendees who challenge this prohibition. Mults can reach up to 480 euros.
But calls for this type of celebrations continue to stand. At least 70 members of the European Parliament plan to attend the Parade of Budapest pride planned for June 28. Last week, lthe Foreign Ministers of 20 EU Member States- among them Spain- They signed a joint letter urging Hungary to review this law. In this letter not only attacks this regulation but also requested the European Commission that “quickly uses all the tools of the rule of law at its disposition” if Hungary continues to move forward with this prohibition.
Brussels has not yet taken a step forward. The commissioner of democracy and rule of law, Michael McGrath, has affirmed that “freedom of meeting is a fundamental right, it is not a threat to children, it is not a threat to anyone and must be protected and defended at all times.”
